The Fair Labor Standards Act (FLSA) is the federal law that establishes a national minimum wage, and requires employers to pay overtime for all hours worked over forty per week, among many other things. The Ohio Constitution, Section 34a, and the Ohio Minimum Fair Wage Standards Act (OMFWSA) protect Ohioans’ rights to minimum wage and overtime payments.  However, there is only a limited amount of time during which an employee can pursue back wages (usually two or three years, depending on the circumstances), so you must act promptly if you believe your rights have been violated.
